As a result of the DOJ/NAR settlement, there are strict requirements imposed on real estate agents and buyers. This is not an option, you have no choice but to sign and nor do agents have options. This SHALL be done.

Harsh statement I know, but it is what it is. You can learn more in the link below. When you choose a broker to represent you, and I continue to work toward earning that opportunity as your broker advocate, before we go out and even look at homes, a BRBC (Buyer Representation and Broker Compensation Agreement) SHALL be signed by you and your broker. These can be exclusive or non-exclusive and vary in duration of time and location of property(ies). We need to discuss these options sooner than later even if you're not quite ready to buy a property. This is serious stuff and agents that fail to do this will be fined and could lose their license. Therefore be careful!

WHAT ABOUT OPEN HOUSES

What about open houses?  Do you have to sign a BRBC just to attend an open house?  No, but you are required to sign an OHNA-SI (Open House Visitor Non-Agency Sign-In) form.  This form serves to disclose to you that the agent holding the open house is NOT representing you, does NOT have a fiduciary duty to you, and therefore anything you say, will be shared with the Seller and used against you in negotiations.  I'm including that form for your review and preparation on my google drive (click here).  Once again, beware of unscrupulous agents that will try to substitute a BRBC binding you or not have you sign anything.
